What exactly am I purchasing?

When you purchase a Sampling CD, or download sound samples from Sounds Online, you are NOT obtaining OWNERSHIP of the sound samples - you are in fact purchasing a LICENSE to use the sound samples within your musical compositions, whether or not your compositions are released commercially. The original producer of the sound samples will always retain OWNERSHIP of the sound samples.

How can I use the sound samples?

You may use the sound samples in combination with other sounds within your musical compositions. You may release such compositions commercially, without payment of any further fees or royalties for such usage. For example, if you are the original purchaser of a Sample CD (or you download sound samples from this site), and you use the sound samples from it to create the soundtrack of a television commercial or a track on a music CD; regardless of how many CDs are sold or how many times the television commercial is broadcast, you would never have to pay the producer of the sound samples any additional royalties or license fees, because you already purchased a license to use the sound samples commercially.

What can't I use the sounds for?

You cannot use the sounds in isolation (i.e. when they are not used within musical compositions) as part of a commercially released project. For example, you cannot use the sounds to make another Sample CD, or include them as individual sound samples on a multimedia CD, gaming machine, or toy, that is commercially distributed. You must add substantial instrumentation to loops* (*loops are compositions that contain a combination of sound samples that can be repeated to form a continuous piece of music). You cannot upload or download the sound samples to any database or server, unless they are used in a musical composition (in combination with other sounds) created by you.

Music or Production Library Use

If you are a music or production library composer/producer using our 'loops' (compositions that contain a combination of sound samples that can be repeated to form a continuous piece of music), the following terms apply -
(1) Loops must be used in a musical context with at least two other instruments that contribute significantly to the composition.
(2) The entire loop cannot be left exposed at any time in the composition.
(3) If you have any doubts a composition meets this criteria, you may submit it to licensing@eastwestsounds.com for written approval.
(Please do not send audio or MP3 files, send us a link to your composition on your web server.)
NOTE: These terms apply to all East West and Quantum Leap products and most third party products sold from this site. If you are in any doubt about a product you intend purchasing, please send an email to licensing@eastwestsounds.com.
NOTE: The exception to this restriction is 'multi-sampled instruments', where users play all of the notes (for example, a multi-sampled piano library).

Who else can use the sounds on the CD that I have purchased?

Nobody, unless they also purchased the same Sample CD or downloaded the same sound sample. Only the ORIGINAL PURCHASER has the right to use the sound samples. This means you CANNOT SELL or give the sounds to anyone else. If you do, and they use the sounds within a commercial release, they, or anyone associated with the distribution of the music, may face legal action from the producer of the sounds. Many of these cases have resulted in multi-million dollar awards to the producer, and ruined the reputation and future job prospects of the composer. It is simply not worth using the sounds 'illegally'.

Can I sell my Sample CD/Virtual Instrument to someone else?

No, the license you are purchasing is NOT TRANSFERABLE at any time. Use of an 'illegally' sold copy may result in legal action from the producer of the sounds. For this reason we caution our customers not to purchase copies of our software from 'online auctions' or 'trading sites', as these are illegal copies in violation of our End User License Agreement.

Do I have to credit the use of the sounds on my CD sleeve, etc?

In most cases this is not required, but is always appreciated (you would credit any musician that played on your track, wouldn't you?). Some CD producers make it an absolute condition within their License Agreement that you must credit them. As always, it is important to read the license that comes with your product.

Keine Angabe von Credits nötig solange die Sounds in einem musikalischen Kontext verwendet werden. Ausdrücklich verboten ist die Verwendung der Samples von VSM oder M-Tron Pro zur Weiterbearbeitung oder zum Rückwärtsabspielen, um daraus neue Samples zu kreieren (bspw. mit EXS25, Mach 5, etc.).

Die Angabe eines Credits ist freiwillig. Durchaus ist erwünscht, dass wenn das Projekt zu einem überwiegenden Teil aus IK-Multimedia Software oder Presets besteht, die Firma IK-Multimedia einen Artikel über den  Komponisten bzw. Produzenten, der diese Software verwendet hat, auf der eigenen Webseite veröffentlichen darf.

The provided samples, instruments and presets can be used for commercial or non-commercial music and audio productions without the prior permission from Native Instruments under the terms of this agreement. The usage of this product for the creation of a sound library or as a sound library for any kind of synthesizer, virtual instrument, sample library, sample-based product or other musical instrument is strictly prohibited. Individual samples, sound
sets or audio loops may not be distributed (commercially or otherwise) standalone. Furthermore these samples, sound sets or audio may not be repackaged in whole or in part as audio samples, sound libraries or sound effects.

Ergänzung vom 25. April 2011: Die Nutzung der beigefügten Grooves ist frei. Auch der Verkauf der eigenen Musik mit den Toontrack Grooves ist erlaubt.
